Terms of Service

By creating an account or using FinalKeepSake (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

FinalKeepSake is a digital legacy platform that helps you organize documents, final wishes, and information your family may need. FinalKeepSake is NOT a law firm and does NOT provide legal, financial, medical, or estate-planning advice. Nothing on this site creates an attorney-client relationship or constitutes professional advice. Always consult a qualified attorney for legal documents.

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate, complete, and up-to-date registration information.

You can start free — no credit card required. When you choose to complete your Family Record, a single one-time $99 charge unlocks the full Service and includes your first 90 days of the FinalKeepSake Family Membership.

After those 90 included days, membership continues at $17.99/month or $179/year (you choose at checkout), billed automatically until you cancel. We will tell you the exact date of your first membership charge before it occurs, and you may cancel anytime before then at no further cost. You can switch between monthly and annual billing.

An optional Guided Setup service is available for a one-time $59. Payments are processed securely by Stripe; we do not store your full card number. All fees are in USD. (Customers on earlier plans keep the pricing they signed up under.)

You may cancel at any time from your Membership & Billing page or by contacting hello@finalkeepsake.com. If you cancel during the 90 included days, you are never charged for membership.

When membership ends, any PDF and ZIP files you have already downloaded remain yours permanently. Your online vault enters a read-only grace period so nothing is lost, and you may export your record at any time during that period. We do not delete your data after a single missed payment — we send reminders before any change. Only after an extended period following cancellation, and after clear notice and an opportunity to export, may online data be removed in accordance with our retention policy.

The one-time $99 charge to complete your Family Record is generally non-refundable once your full record has been unlocked, as it includes immediate access to the complete Service and 90 days of membership. Membership fees are generally non-refundable, though you can cancel anytime to prevent future charges. The optional $59 Guided Setup is non-refundable once scheduled or delivered. You own your data. You retain full ownership of the documents, information, and content you upload to FinalKeepSake. By using the Service, you grant us a limited, non-exclusive license to store, display, and transmit your content solely for the purpose of providing the Service to you. We do not sell your data or use it for advertising.

You agree not to use FinalKeepSake to:

• Upload or store illegal content or malware
• Violate any applicable law or regulation
• Impersonate another person
• Attempt to gain unauthorized access to our systems
• Use the Service in any way that could harm, disable, or impair it

We reserve the right to suspend or terminate accounts that violate these terms without notice.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. FINALKEEPSAKE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

UPLOADING A DOCUMENT TO FINALKEEPSAKE DOES NOT CREATE, VALIDATE, EXECUTE, OR REPLACE A LEGAL WILL, TRUST, POWER OF ATTORNEY, OR ANY OTHER LEGAL INSTRUMENT. YOUR UPLOADED DOCUMENTS ARE ORGANIZATIONAL TOOLS ONLY.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FINALKEEPSAKE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

We aim for high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance and will attempt to provide advance notice when possible. We are not liable for any downtime or data loss resulting from circumstances beyond our reasonable control.

These Terms are governed by the laws of the United States without regard to conflict-of-law principles. Any dispute arising from these Terms shall be resolved through binding arbitration or in the applicable courts of competent jurisdiction.

We may update these Terms from time to time. When we make material changes, we will notify you by email or by an in-app notice at least 14 days before the changes take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
